A power of attorney in Dubai is one of the most powerful legal documents you can sign. It hands another person the authority to act on your behalf, sometimes over your property, your finances, or your business. That level of trust, when misplaced or misused, is where POA fraud begins.

POA fraud is not a rare occurrence. It ranges from an agent acting outside the scope of their authority to a fully fraudulent POA being used to transfer property or access funds without the principal’s knowledge. The good news is that most cases are preventable with the right approach from the start.

1. Use a Special POA, Not a General One

One of the most effective ways to prevent POA fraud is to limit the scope of authority from the outset. A General Power of Attorney gives the agent broad control over your affairs, which creates more room for misuse and makes POA fraud harder to detect and contain.

A Special Power of Attorney restricts authority to a single, defined action: selling a specific property, renewing a specific vehicle registration, or managing a specific bank account. The narrower the authority, the less a fraudulent POA can be used to do. Always match the POA type to the exact task at hand, nothing broader.

2. Set a Clear Expiry Date

An open-ended POA Dubai document is a significant POA fraud risk. A POA with no expiry date remains valid indefinitely and can be used long after the original transaction is complete, or long after the relationship between you and your agent has changed.

Every POA should include a specific expiry date tied to the purpose for which it was issued. For property sale transactions, Dubai Land Department regulations cap Special POA validity at two years. For other transaction types, setting an expiry of six months to one year is a practical standard that helps prevent POA fraud through an expired but still-circulating document.

3. Always Notarise and Register Correctly

A document that has not been properly notarised carries less legal protection against POA fraud. Notarisation through a licensed UAE notary public or the UAE’s official e-notary system creates a verifiable record of the document, the parties involved, and the date of execution. A fraudulent POA that bypasses this process is easier to fabricate and harder to challenge once acted on.

For documents notarised outside the UAE, legalisation through the UAE Embassy in the relevant country, followed by attestation at the UAE Ministry of Foreign Affairs, is required before the POA can be used in Dubai.

4. Choose Your Agent With Extreme Care

The most common source of POA fraud is not a forged document. It is a trusted person who exceeds or abuses the authority they were genuinely given. When choosing someone to act under a power of attorney in Dubai, the decision carries real legal and financial consequences.

Where possible, appoint joint agents who must act together, preventing either party from acting unilaterally. If a single agent is necessary, choose someone with no personal financial interest in the outcome. Anyone with a stake in the result has a motive that can compromise their judgment and create the conditions for POA fraud. 

5. Know the Legal Protections Already in Place

Under DLD Circular No. 29/R/2025, all powers of attorney submitted at real estate registration centres now require mandatory electronic verification through the DLD portal. The registrar must cross-check the principal’s name, Emirates ID, and passport number before any property transaction can proceed.

The same circular prohibits agents from receiving sale proceeds on behalf of a property owner.Similar verification standards apply to POA Dubai documents submitted to the Roads and Transport Authority.

6. Monitor and Revoke When Necessary

Preventing POA fraud does not end at the point of signing. The principal retains the right to revoke a POA at any time, provided the revocation is formally registered through the same authority that issued the original document.

If you suspect misuse, revoke the document immediately and seek legal advice. A fraudulent POA that has already been acted on may require civil action or a police report, but early revocation limits further damage.

Prepare a POA That Protects You From the Start 

POA fraud rarely happens without warning signs. A document that is too broad, an agent who was never properly vetted, or a POA that was never formally revoked after use are the gaps that make fraud possible.
